What is Mediation?
Mediation is a confidential, consensual and without prejudice process that allows participants to explore a full range of potential solutions, often commercial in nature. The mediator acts as a “neutral” employing the use of principled negotiation* based upon reason and objective criteria. Mediation can be held in-person or by video online which is especially useful in saving time and costs for geographically dispersed participants.
*Principled Negotiation was made famous by Fisher and Ury of the Harvard Negotiation Project in their book Getting to Yes, and others.
